We have written this document to explain our practices clearly. Nothing here removes any right or remedy that cannot lawfully be excluded under applicable Indian law.

Section 01

Acceptance and application

These Terms & Conditions govern access to digileap5.in and the purchase or use of DigiLeap5 services supplied by MyDesignNexus. By submitting a booking, making a payment, approving a proposal or asking us to begin work, you confirm that you have read and accepted these Terms.

A proposal, order form, scope document or signed agreement may add project-specific terms. If a project-specific written agreement conflicts with these website Terms, the project-specific agreement controls for that project to the extent permitted by law.

Section 02

Eligibility and authority

You must be at least 18 years old and legally capable of entering a contract. If you act for a business or another person, you confirm that you have authority to provide instructions, approve content, grant access and make payment on their behalf.

Section 03

Service scope

The advertised DigiLeap5 package is a coordinated digital-launch service. The current public offer is ₹9,999 plus applicable GST and may include a customised 15-page website, first-year domain and SSL where stated, search foundations, Google Business Profile submission, social setup, agreed launch creatives, one month of social launch management, one year of routine website maintenance and handover.

Only items listed in the accepted written scope are included. Custom software, e-commerce, paid advertising spend, premium plugins, paid stock assets, extensive copywriting, additional pages, integrations, new functionality and work outside the accepted scope require a separate quote.

Section 04

Pricing, taxes and payments

  • The advertised package price is ₹9,999, exclusive of applicable GST unless expressly stated otherwise.
  • The current reservation amount is ₹999 and is credited toward the accepted package balance.
  • The remaining balance and payment milestones will be stated in the proposal, invoice or order confirmation.
  • Work may be paused if an agreed payment is overdue.
  • Third-party costs and renewal charges are payable as identified in writing.

Prices, capacity and promotional availability may change for future bookings. A confirmed written booking will not be retrospectively changed except by mutual agreement or where a correction is required by law.

Section 05

Reservation and scheduling

A payment does not start the five-hour delivery clock. It requests or reserves capacity subject to payment confirmation, eligibility, scope agreement, slot availability and completion of the kickoff requirements.

We will confirm the scheduled slot through an agreed communication channel. Promotional references to a limited number of businesses or slots describe current campaign capacity and do not guarantee acceptance before confirmation.

Section 06

Kickoff conditions

The five-working-hour sprint begins only when all required conditions are met:

  • The scheduled launch slot has started.
  • The agreed booking payment or milestone has cleared.
  • The intake is complete and the decision-maker is available.
  • Logo, business details, services, pricing, photos and approved content are supplied.
  • The domain choice and written scope are approved.
  • Required platform access is provided through an agreed secure method.
  • No unresolved instruction, legal, technical or policy issue prevents work.

An incomplete or delayed kickoff moves the sprint to the next mutually available slot. Time spent waiting for client information, access, decisions or approvals is not part of the delivery clock.

Section 07

Five-working-hour commitment

The commitment covers deliverables directly controlled by MyDesignNexus and expressly included in the accepted scope. Completion may include publishing the website, configuring agreed profiles, submitting the Google Business Profile, scheduling approved content and sending the delivery summary.

The commitment does not guarantee third-party approval, indexing, verification, propagation, account recovery, review, advertising approval or platform uptime. The remedy for an eligible missed commitment is governed by our Refund Policy and the accepted written offer.

Section 08

Client responsibilities

You agree to:

  • Provide accurate, lawful and complete business information.
  • Own or hold permission to use every logo, image, video, trademark, testimonial and text supplied.
  • Review factual, pricing, regulatory and industry-specific claims before approval.
  • Provide timely decisions and one authorised point of contact.
  • Use secure access methods and remove unnecessary access after handover.
  • Maintain licences, registrations, permissions and disclosures required for your business.
  • Pay agreed fees and third-party renewals when due.

MyDesignNexus may refuse content or instructions that appear unlawful, deceptive, infringing, unsafe or contrary to a platform policy.

Section 09

Review, revisions and acceptance

The included revision process and approval window will be described in the accepted scope. Corrections that bring work into the agreed scope are different from new pages, redesigned directions, additional features or changed requirements, which may be quoted separately.

A deliverable is treated as accepted when you approve it in writing, publish or use it, or do not report a specific scope-related issue within the review period stated in the project communication.

Section 10

Ownership and licences

After payment of all agreed fees, the client owns the final custom website code, registered domain held for the client and approved project assets created specifically for the project, subject to third-party rights and the written scope.

Pre-existing MDN methods, internal tools, reusable components, templates, know-how and licensed third-party materials remain owned by their respective owners. The client receives the licence reasonably required to use incorporated material in the delivered project. Open-source and third-party software remain governed by their own licences and terms.

Section 11

Maintenance and renewals

One year of routine website maintenance is included when stated in the accepted package. Routine maintenance means reasonable upkeep, compatibility corrections, small text or image updates and support within the agreed technical stack. It does not include new pages, new features, major redesigns, content campaigns, emergency recovery caused by third parties or work outside the original scope.

Domain, hosting, email, plugin, platform and ongoing-service renewals after the included period are chargeable at the written renewal rate. Failure to pay a third-party renewal may interrupt the relevant service.

Section 12

Third-party platforms

Google, Meta, domain registrars, hosting providers, payment gateways, social networks, messaging providers and other platforms are independent services. Their availability, review, verification, indexing, advertising approval, policies, pricing and account decisions are outside MDN’s control. You must comply with their terms, and MDN cannot promise a result that only the third party can decide.

Section 13

No guaranteed commercial results

Unless a separate written agreement expressly says otherwise, MyDesignNexus does not guarantee a specific search position, Google verification date, advertising approval, number of enquiries, sales, revenue or return on investment. Performance depends on market demand, offer quality, competition, client operations, platform systems and other factors beyond website delivery.

Section 14

Confidentiality and project display

Each party will take reasonable care of non-public business information received for the project and use it only for authorised delivery, support, legal or security purposes.

Unless you request confidentiality in writing before publication, MDN may identify publicly launched work in its portfolio without exposing credentials, private analytics, customer lists or other confidential information.

Section 15

Cancellation and refunds

Cancellation, rescheduling, duplicate payments, non-recoverable costs and the five-hour remedy are governed by our Refund Policy. That policy forms part of these Terms.

Section 16

Responsibility and liability

Each party remains responsible for its own acts, instructions, content, systems and legal obligations. To the extent permitted by law, neither party is liable for indirect, special or consequential losses that were not reasonably foreseeable when the service was agreed.

To the extent permitted by law, MDN’s aggregate contractual liability for a claim is limited to the amount paid to MDN for the specific affected service. This limitation does not apply where liability cannot lawfully be excluded or limited, including applicable consumer rights, fraud or wilful misconduct.

Section 17

Suspension and termination

We may pause or terminate work for non-payment, unsafe access requests, abusive conduct, unlawful content, infringement, material misrepresentation or another serious breach. Where practical, we will explain the issue and allow a reasonable opportunity to correct it. Fees for completed work and non-recoverable third-party costs remain payable.

Section 18

Events beyond reasonable control

Neither party is responsible for delay caused by events reasonably beyond its control, including widespread connectivity failure, cloud or platform outage, cyberattack, government action, natural disaster, public emergency or power disruption. The affected party will take reasonable steps to reduce delay and resume performance.

Section 19

Governing law and disputes

These Terms are governed by the laws of India. The parties should first try to resolve a dispute in good faith through the contact details below. If it is not resolved, courts with appropriate jurisdiction in Hassan, Karnataka will have jurisdiction, subject to any mandatory legal forum or consumer remedy that cannot be excluded.

Nothing in these Terms prevents an eligible person from using a statutory consumer or regulatory remedy available under applicable law.

Section 20

Changes to these Terms

We may update these website Terms for future use when the offer, technology or law changes. The effective date will be updated. Material changes will not silently replace a confirmed project-specific written agreement.
